Administrative Versus Court-Ordered Suspensions

An administrative suspension originates with the NDDOT Director of the Driver License Division. Common triggers include accumulating too many points, failing to maintain required insurance, or refusing a chemical test. The NDDOT notice will state "administrative suspension" and reference the Director's authority.

A court-ordered suspension originates with a district or municipal court following a DUI conviction, reckless driving conviction, or other criminal traffic offense. The NDDOT notice will reference the court order and the originating court's name. You cannot pay the reinstatement fee until the court files a clearance with NDDOT confirming you satisfied all court-imposed conditions: fines, treatment programs, probation terms, and any ignition-interlock requirement.

If your suspension is court-ordered and the court has not yet filed clearance, NDDOT will reject your reinstatement-fee payment and return it unprocessed. Contact the court clerk at the originating court to confirm clearance status before attempting payment.

Accepted Payment Methods and Processing Time

Mail payment to NDDOT Driver License Division, 608 E Boulevard Ave, Bismarck ND 58505. Include a check or money order payable to NDDOT, your full name, date of birth, and driver license number. Mailed payments take 10 to 15 business days to process after NDDOT receives the envelope. Do not mail cash. NDDOT does not confirm receipt until processing completes, so allow three weeks from the date you mail the payment before expecting reinstatement.

In-person payment at any NDDOT Driver License site processes same-day. Bring the reinstatement notice, a government-issued photo ID, and payment by check, money order, or credit card. NDDOT accepts Visa, MasterCard, and Discover with a convenience fee added by the payment processor. Cash is not accepted at most locations. Same-day processing means your driving privilege is restored immediately after payment clears, but you must still obtain proof of financial responsibility before driving.

Proof of Financial Responsibility Comes Before Reinstatement

North Dakota requires proof of financial responsibility before reinstatement when the suspension stemmed from a crash where you had no insurance, a DUI conviction, or accumulation of points. Proof means an SR-22 certificate filed by a licensed carrier and maintained for the period NDDOT specifies, typically one year. The carrier files the SR-22 electronically with NDDOT; you do not mail a paper certificate.

Obtain the SR-22 before paying the reinstatement fee. If you pay the fee first and NDDOT has no SR-22 on file, your license remains suspended until the carrier files. Most carriers file SR-22 certificates within one business day of policy purchase, but NDDOT's system updates overnight. Expect a one-to-two-day lag between the carrier's filing and NDDOT's confirmation that proof is on file.

Not every suspension requires an SR-22. Administrative suspensions for failure to pay a ticket or failure to appear in court typically do not trigger the proof-of-financial-responsibility requirement. The NDDOT reinstatement notice will state whether proof is required.

ND SR-22 Filing Period

North Dakota requires SR-22 filing for one year after reinstatement when the suspension stemmed from DUI, operating while suspended for 91 or more days, or a crash with no insurance in effect. The filing period begins on the date NDDOT receives the SR-22, not the date of conviction or suspension.

Court-ordered suspensions often carry additional fines imposed by the court separate from the NDDOT reinstatement fee. The court clerk at the originating court can provide a balance statement. Pay the court fines directly to the court, not to NDDOT.

What Happens After Payment Clears

NDDOT processes the reinstatement fee and updates your driving record within one business day for in-person payments and 10 to 15 business days for mailed payments. Once processing completes, your license status changes from suspended to valid, but you cannot drive until you obtain a physical license card. If your license expired during the suspension period, you must renew it in person at a driver license site and pay the standard renewal fee in addition to the reinstatement fee.

Verify reinstatement status online at dot.nd.gov before driving. The NDDOT online driver record system updates overnight after payment clears. If the system still shows a suspended status more than two business days after in-person payment or three weeks after mailed payment, contact the Driver License Division at 701-328-2600. Driving on a suspended license after paying the fee but before NDDOT updates the record is still a violation; wait for confirmation that the status changed to valid before operating a vehicle.
